Truthy Terms of Service

These Terms of Use (“Terms”) form a legally binding agreement between you (“you” or “User”) and SparkJam Co., Limited (“Truthy,” “Company,” “we,” “us,” or “our”) regarding your access to and use of the Truthy mobile applications, website, and related features, subscriptions, content, and services collectively referred to as the “Services.”

By downloading, accessing, purchasing, subscribing to, or using the Services, you confirm that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you must not access or use the Services.

These Terms incorporate by reference our Privacy Policy and any additional notices, disclosures, or rules presented within the Services.

Agreement to Terms

Your use of Truthy is subject to these Terms, our Privacy Policy, and any additional instructions or disclosures presented within the Services.

We may update these Terms from time to time to reflect changes to the Services, applicable laws, platform requirements, or our business practices.

The updated Terms will become effective when published through the App, our website, or another reasonable method, unless applicable law requires additional notice or consent.

If you do not agree with an updated version, you must discontinue use of the Services.

Definitions

For the purposes of these Terms:

“App” means the Truthy mobile application made available through the Apple App Store, Google Play, or another authorized distribution channel.

“Services” means the App, website, Public Source Search, AI-assisted source organization, source-based answers, search history, Saved Research, subscriptions, customer support, and related services provided by Truthy.

“User” means any person who downloads, accesses, purchases, subscribes to, or uses the Services.

“Search Query” means a user-initiated request using a username, public account handle, keyword, publicly accessible webpage link, or another supported query.

“User Inputs” means information voluntarily submitted by a User, including Search Queries, public URLs, feedback, support messages, correction requests, removal requests, and voluntarily selected attachments.

“Public Sources” means publicly accessible websites, publicly indexed webpages, public social media pages, and other sources available without bypassing login requirements, privacy settings, passwords, or access restrictions.

“Source Results” means publicly accessible links, source titles, platform information, public snippets, source categories, or source-based summaries displayed in response to a Search Query.

“Saved Research” means Search Queries, Source Results, source categories, or source-based summaries that a User actively chooses to save where this feature is available.

“Subscription” means paid access to premium features offered through the Apple App Store, Google Play, or another authorized payment platform.

“Third-Party Services” means external platforms, websites, APIs, search providers, AI providers, hosting providers, analytics providers, attribution providers, payment platforms, or other service providers that support the Services.

Eligibility

The Services are intended for Users aged 17 or older.

If you are under the age of legal majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

By using the Services, you represent that:

  1. you meet the applicable age requirements;
  2. you have the legal capacity or required authorization to agree to these Terms;
  3. you are not prohibited from using the Services under applicable law, regulation, court order, or platform policy; and
  4. you will use the Services only for lawful purposes.

The Services are not intended to be used to search for, monitor, profile, target, or make decisions about minors.

Nature of the Services

Truthy is an AI-assisted public source search service.

Users may submit a Search Query, and Truthy may locate and organize publicly accessible links that appear relevant to that query.

The Services may include:

  • Public Source Search;
  • Social Source and Web Source categorization;
  • Source deduplication;
  • Source relevance organization;
  • Link availability checks;
  • Source-based AI summaries;
  • Search refinement;
  • Saved Research; and
  • Result reporting and correction tools.

Source Results are displayed as independent sources related to a Search Query.

Truthy does not represent or guarantee that:

  • A Source Result belongs to a particular individual;
  • Different Source Results belong to the same person;
  • A username uniquely identifies a particular individual;
  • A Source Result accurately reflects the User’s intended subject; or
  • Information published by a third party is accurate, complete, lawful, or current.

Truthy does not provide candidate people, individual profiles, identity verification, facial recognition, photo matching, background reports, or private account discovery.

Truthy does not intentionally access private messages, private accounts, contact lists, password-protected pages, login-restricted content, or information obtained by bypassing access controls.

The Services are provided for lawful, personal, non-commercial, and informational use only.

Truthy is not a consumer reporting agency, background screening provider, employment screening provider, tenant screening provider, credit reporting provider, insurance eligibility provider, law enforcement service, or private investigation service.

User Responsibilities

You are solely responsible for your use of the Services and for all User Inputs you submit.

You represent and warrant that:

  1. you have the lawful right and authority to submit your User Inputs;
  2. your User Inputs are not unlawful, misleading, abusive, defamatory, invasive, discriminatory, or harmful;
  3. you will not submit passwords, payment credentials, government identification numbers, private communications, biometric information, health information, or other unnecessary sensitive information;
  4. you will independently review the original Public Sources before relying on any Source Result;
  5. you will not treat Source Results or AI-generated content as verified facts;
  6. you will comply with applicable laws, platform rules, and third-party terms; and
  7. you will not use the Services to harm, harass, threaten, intimidate, exploit, expose, or discriminate against another person.

You are responsible for maintaining access to your device, Apple or Google account, purchase status, and any local information used to provide the Services.

Deleting the App, changing devices, resetting your device, or clearing local data may affect access to local history, unsaved results, or other locally stored information.

Deleting the App does not automatically cancel an active Subscription.

User Inputs and Permission to Process

You retain any rights you may have in your User Inputs.

By submitting User Inputs, you grant Truthy a limited, non-exclusive, worldwide, royalty-free license to access, process, transmit, temporarily store, organize, and display those User Inputs only as reasonably necessary to:

  • Provide the requested Services;
  • Process a Search Query;
  • Generate Source Results;
  • Organize or summarize Public Sources;
  • Maintain security;
  • Prevent fraud or abuse;
  • Investigate technical problems;
  • Respond to support requests; and
  • Comply with applicable law.

Certain User Inputs may be transmitted to selected Third-Party Services, including search, cloud, hosting, and AI providers, where necessary to perform the requested functionality.

Where required by applicable law or platform policy, Truthy will provide an appropriate in-app disclosure and request affirmative permission before personal information is first shared with a third-party AI provider.

Truthy does not grant analytics, advertising, or attribution providers permission to use raw Search Queries, searched usernames, Source Result URLs, or source-based summaries for targeted advertising, cross-app tracking, or individual profiling.

Unless separately disclosed and permitted, User Inputs will not be used to train general-purpose third-party AI models.

AI-Generated Content and Source Results

Truthy may use automated systems and artificial intelligence to:

  • Categorize Public Sources;
  • Remove duplicate links;
  • Rank potentially relevant links;
  • Summarize the subject matter of a source;
  • Identify source types or common topics; and
  • Improve the presentation of Source Results.

AI-generated content may be incomplete, inaccurate, duplicated, misclassified, unrelated, unavailable, or outdated.

Truthy does not guarantee:

  1. the accuracy, completeness, timeliness, or reliability of any Source Result;
  2. that a Source Result relates to the person, account, organization, or subject intended by the User;
  3. that different Source Results relate to the same individual or entity;
  4. that all relevant Public Sources will be found;
  5. that every displayed link will remain available;
  6. that an AI-generated summary fully or correctly represents the original source; or
  7. that third-party content is lawful, authorized, accurate, or current.

AI-generated summaries are intended to describe or organize the content of individual sources. They are not intended to create an individual profile, verify identity, assess a person’s character, or confirm ownership of an account.

Users must review the original source and independently verify important information before taking action.

Public Sources and Result Requests

Source Results are based on publicly accessible information made available by third-party websites and platforms.

Truthy does not create, own, control, or verify the underlying third-party content.

A link appearing in Truthy does not imply:

  • Endorsement;
  • Partnership;
  • Sponsorship;
  • Authorization;
  • Identity verification;
  • Account ownership verification; or
  • Affiliation with the source operator.

Truthy may provide functions such as:

  • Report Result;
  • Wrong Link;
  • Correction Request;
  • Remove Result; and
  • Contact Support.

If you believe a Source Result is incorrect, links to the wrong source, creates a safety risk, violates your rights, or should no longer be displayed, you may submit a request containing the affected URL and a description of the issue.

We may request reasonable information to evaluate or verify the request.

We may review, restrict, correct, or remove a Source Result from Truthy where appropriate, but we are not required to alter the underlying third-party content.

Removing a link from Truthy does not remove the original information from the third-party website. Requests concerning the original content should also be directed to the operator of the original source.

Subscriptions, Billing, and Payment

Certain features may require a paid Subscription.

Truthy may offer weekly, annual, introductory, promotional, trial, or other subscription plans.

The applicable:

  • Price;
  • Currency;
  • Billing period;
  • Introductory price;
  • Renewal price;
  • Trial period;
  • Included features; and
  • Renewal terms

will be displayed before purchase.

Subscriptions purchased through the Apple App Store are processed and managed by Apple.

Subscriptions purchased through Google Play are processed and managed by Google.

Truthy does not collect or store complete payment card information, card security codes, Apple account passwords, Google account passwords, or other complete payment credentials.

Unless otherwise stated at purchase, Subscriptions automatically renew until canceled through the applicable platform.

You are responsible for managing or canceling your Subscription through your Apple App Store or Google Play account settings.

Cancellation generally takes effect at the end of the current paid billing period, unless applicable law or platform rules provide otherwise.

Deleting the App does not cancel a Subscription.

Refund requests are handled by the applicable payment platform according to its rules and applicable law. Truthy does not control Apple’s or Google’s payment authorization, billing, cancellation, or refund decisions.

Truthy may change future pricing, available plans, included features, usage limits, or promotional offers. Any price change will be implemented in accordance with applicable law and platform requirements.

Purchase Restoration and Service Identifiers

Truthy does not currently require Users to create a conventional account using an email address and password.

Truthy may use purchase records, platform transaction information, installation information, or an internal service identifier to:

  • Verify subscription entitlement;
  • Restore purchases;
  • Maintain service access;
  • Prevent fraud;
  • Investigate billing issues; and
  • Provide customer support.

Apple and Google manage the User’s respective platform account and payment credentials.

Truthy does not receive the User’s complete Apple or Google account credentials.

The ability to restore a purchase may depend on the applicable platform, the account used for the original purchase, and the continuing availability of the relevant product.

Search History and Saved Research

Truthy may provide recent search history or Saved Research functions.

Where available, these functions may contain:

  • Search Queries;
  • Public Source URLs;
  • Source categories;
  • Source titles;
  • Source-based summaries; and
  • Related organizational information.

Saved Research is stored only where the User actively chooses to save it or where the relevant feature is clearly enabled.

Search history, Saved Research, and Source Results may change, become unavailable, or be removed because of:

  • User deletion;
  • Retention limits;
  • Link expiry;
  • Changes to third-party sources;
  • Changes to algorithms or service providers;
  • Product changes;
  • Security requirements; or
  • Legal obligations.

Truthy does not guarantee permanent availability of Source Results, Saved Research, search history, or local app state.

Truthy does not use search history to build a reusable database of individual profiles.

Information is retained and deleted in accordance with our Privacy Policy.

Prohibited Uses

You must not use the Services for any unlawful, harmful, abusive, exploitative, discriminatory, commercial, or unauthorized purpose.

You must not:

  1. use the Services to stalk, harass, intimidate, threaten, shame, exploit, blackmail, extort, dox, surveil, or harm any person;
  2. use the Services to identify, monitor, profile, target, or make decisions about minors;
  3. use Source Results to make decisions relating to employment, hiring, promotion, termination, housing, tenancy, credit, lending, insurance, education, benefits, licensing, or another regulated eligibility purpose;
  4. use the Services as a background check, consumer report, identity verification service, or regulated screening tool;
  5. discriminate against any person based on a protected characteristic;
  6. violate another person’s privacy, publicity, contractual, intellectual property, or other legal rights;
  7. claim or represent that Truthy has verified a person’s identity or confirmed ownership of an account;
  8. attempt to access private accounts, private messages, login-restricted content, passwords, paywalls, or other protected resources;
  9. bypass privacy settings, access controls, CAPTCHAs, rate limits, robots restrictions, or technical protections;
  10. create, enrich, sell, license, or distribute databases about individuals using Source Results;
  11. scrape, crawl, harvest, mine, copy, or systematically extract information from the Services;
  12. use bots, scripts, automated tools, or non-human access methods without written permission;
  13. reverse engineer, decompile, disassemble, modify, or attempt to derive the source code or underlying systems of the Services;
  14. interfere with, overload, disrupt, damage, or compromise the Services, servers, networks, or security systems;
  15. upload malware, spyware, harmful code, or unauthorized tracking technologies;
  16. impersonate another person or submit materially false or misleading information;
  17. resell, sublicense, redistribute, publicly display, or commercially exploit the Services or Source Results without written permission;
  18. submit false or abusive reports or misuse support and removal channels;
  19. use the Services to develop or train a competing database, search product, model, or service without authorization; or
  20. use the Services in violation of applicable law, platform rules, these Terms, or third-party terms.

Violation of these Terms may result in restriction, suspension, termination, removal of information, denial of future access, or legal action.

Refund eligibility following suspension or termination remains subject to applicable law and the rules of the payment platform.

Third-Party Services, Sources, and Links

The Services may rely on, display, link to, or interact with Third-Party Services.

Third-Party Services are not controlled by Truthy.

We are not responsible for their:

  • Content;
  • Accuracy;
  • Availability;
  • Legality;
  • Security;
  • Privacy practices;
  • Data processing;
  • Ranking or indexing;
  • Account policies;
  • Removal practices; or
  • Terms of use.

When you open a Source Result, you leave the Truthy environment and interact directly with the third party.

You are responsible for reviewing and complying with the third party’s terms, privacy policy, and other applicable rules.

Truthy does not guarantee that a third-party link will remain active, accessible, or unchanged.

Privacy

Your use of the Services is subject to our Privacy Policy.

The Privacy Policy explains how we collect, use, disclose, store, protect, retain, and delete information.

It also explains how Search Queries may be processed by our servers and selected search, cloud, or AI service providers.

If you do not agree with our Privacy Policy or an applicable in-app data disclosure, you must not use the affected feature.

Where processing depends on consent, you may withdraw that consent through available in-app controls, operating system settings, or by contacting us.

Withdrawing consent may limit or prevent access to functionality that requires the relevant processing.

Intellectual Property Rights

The Services, including the App, website, software, source code, interfaces, designs, logos, icons, graphics, text, workflows, algorithms, models, prompts, source classification systems, brand assets, and documentation, are owned by or licensed to Truthy.

They are protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, Truthy grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services for lawful, personal, and non-commercial purposes.

You may not copy, reproduce, distribute, sell, license, modify, publicly display, create derivative works from, reverse engineer, scrape, or otherwise exploit the Services except where expressly permitted by these Terms or applicable law.

Third-party Public Sources remain owned or controlled by their respective owners.

Displaying or linking to a Public Source does not transfer ownership of that content to Truthy or the User.

Feedback and Submissions

You may submit feedback, suggestions, bug reports, result reports, correction requests, removal requests, screenshots, images, or other communications collectively referred to as “Submissions.”

You retain ownership of content that you submit.

You grant Truthy permission to access, reproduce, analyze, and use a Submission only as reasonably necessary to:

  • Investigate the reported issue;
  • Provide customer support;
  • Process a correction or removal request;
  • Fix technical problems;
  • Improve relevant product functionality; and
  • Protect the Services.

If you voluntarily attach an image or screenshot, you represent that you have the lawful right to submit it.

Attachments submitted through support or feedback are not used for facial recognition, photo matching, identity verification, Public Source Search, biometric analysis, advertising personalization, or cross-app tracking.

Do not submit unnecessary sensitive information.

Retention and deletion of Submissions are governed by our Privacy Policy.

Mobile Application Terms

Apple App Store

If you access the App through the Apple App Store, your license is limited to use on Apple-branded devices that you own or control, subject to Apple’s applicable usage rules.

Apple is not responsible for providing maintenance or support for the Services, except where required by applicable law.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may provide a refund where required under its policies. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions against you.

Google Play

If you access the App through Google Play, your use is also subject to Google Play’s applicable terms, policies, billing rules, and account settings.

Google is not responsible for providing support, maintenance, refunds, or warranties except as required under its applicable policies or law.

Where these Terms conflict with mandatory platform requirements, the applicable mandatory platform requirement will control.

Service Availability and Changes

Truthy may update, modify, limit, suspend, replace, or discontinue any part of the Services.

We do not guarantee that:

  • The Services will always be available;
  • Every Search Query will return results;
  • Every Source Result will remain accessible;
  • Third-Party Services will continue operating;
  • Features will be available in every country or on every device; or
  • The Services will be uninterrupted or error-free.

The Services may be affected by maintenance, technical issues, network failures, provider outages, rate limits, legal requirements, security incidents, or events beyond our reasonable control.

Where reasonably practical and legally required, we may provide notice of material changes affecting paid functionality.

Corrections

The Services may contain errors, omissions, broken links, outdated information, incorrect categories, inaccurate summaries, pricing errors, or other mistakes.

We reserve the right to correct, update, restrict, remove, or revise information within the Services.

Correction of a Source Result within Truthy does not change information published by the original third-party source.

No Warranty

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUTHY DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, OR OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, AND SECURITY.

WE DO NOT WARRANT THAT:

  1. THE SERVICES WILL MEET YOUR EXPECTATIONS;
  2. SOURCE RESULTS WILL BE ACCURATE, COMPLETE, CURRENT, RELEVANT, OR RELIABLE;
  3. A SOURCE RESULT RELATES TO THE PERSON OR SUBJECT INTENDED BY THE USER;
  4. MULTIPLE SOURCE RESULTS RELATE TO THE SAME PERSON;
  5. AI-GENERATED CONTENT WILL CORRECTLY REPRESENT THE ORIGINAL SOURCE;
  6. ALL RELEVANT PUBLIC SOURCES WILL BE FOUND;
  7. THIRD-PARTY SERVICES WILL REMAIN AVAILABLE OR OPERATE CORRECTLY; OR
  8. THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

SOURCE RESULTS AND AI-GENERATED CONTENT ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY.

THEY MUST NOT BE TREATED AS IDENTITY VERIFICATION, FACTUAL CERTIFICATION, A BACKGROUND CHECK, A CONSUMER REPORT, LEGAL ADVICE, OR A SAFETY GUARANTEE.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUTHY AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THIS INCLUDES LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSS ARISING FROM OR RELATING TO:

  1. YOUR USE OF OR INABILITY TO USE THE SERVICES;
  2. ACTIONS TAKEN BASED ON SOURCE RESULTS OR AI-GENERATED CONTENT;
  3. INACCURATE, INCOMPLETE, DUPLICATED, OUTDATED, BROKEN, OR IRRELEVANT RESULTS;
  4. THIRD-PARTY WEBSITES, PUBLIC SOURCES, PLATFORMS, APIS, OR SERVICE PROVIDERS;
  5. LOSS OF SEARCH HISTORY, SAVED RESEARCH, LOCAL DATA, OR SERVICE STATE;
  6. UNAUTHORIZED ACCESS TO YOUR DEVICE OR PLATFORM ACCOUNT;
  7. INTERACTIONS WITH A PERSON OR ENTITY REFERENCED BY A SOURCE RESULT; OR
  8. YOUR VIOLATION OF APPLICABLE LAW, THIRD-PARTY RIGHTS, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  • USD $50.

Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, liability will be limited only to the extent permitted by applicable law.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Truthy and its affiliates, directors, officers, employees, contractors, agents, licensors, and service providers from claims, liabilities, losses, damages, costs, and reasonable legal fees arising from:

  1. your misuse of the Services;
  2. your violation of these Terms;
  3. your violation of applicable law or third-party rights;
  4. User Inputs or Submissions that you were not authorized to provide;
  5. your use of Source Results for harassment, surveillance, discrimination, screening, or another prohibited purpose;
  6. your representation that Truthy verified a person or confirmed account ownership; or
  7. a dispute between you and a third party resulting from your use of the Services.

We reserve the right to assume control of the defense of a matter subject to indemnification, and you agree to provide reasonable cooperation.

Suspension and Termination

These Terms remain effective while you use the Services.

We may restrict, suspend, or terminate access where we reasonably believe that:

  1. you violated these Terms or another applicable policy;
  2. your use creates legal, security, operational, privacy, reputational, or safety risks;
  3. you violated another person’s rights;
  4. payment was not completed, authorized, or renewed;
  5. you misused Source Results;
  6. suspension is required by law, court order, regulator, or platform policy; or
  7. continued access is no longer technically or commercially feasible.

Where reasonable and legally required, we may provide notice before termination.

Termination may result in loss of access to paid features, search history, Saved Research, local app state, or other information.

Termination of access does not automatically cancel an external platform Subscription. Users remain responsible for managing subscriptions through Apple or Google.

Sections that by their nature should survive termination will remain effective, including intellectual property, prohibited uses, disclaimers, limitation of liability, indemnification, dispute resolution, and privacy-related provisions.

User Data

We may maintain limited information as necessary to provide, secure, troubleshoot, support, and improve the Services, subject to our Privacy Policy.

You may request access, correction, deletion, or removal of applicable information as described in the Privacy Policy.

Although we use reasonable measures to maintain service integrity, you are responsible for keeping independent copies of information that is important to you.

We do not guarantee permanent storage of Search Queries, Source Results, Saved Research, support communications, or other information.

Electronic Communications

By using the Services, contacting us, submitting a form, or making a purchase, you agree to receive service-related electronic communications.

These communications may include:

  • Transaction confirmations;
  • Subscription information;
  • Policy notices;
  • Security notifications;
  • Support responses; and
  • Legally required notices.

Marketing communications will be sent only where permitted by law and may be discontinued using the available unsubscribe method.

Nothing in this section limits privacy or consumer protection rights available under applicable California law.

Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your jurisdiction require otherwise.

Nothing in these Terms limits rights that cannot lawfully be waived.

Before initiating formal proceedings, you and Truthy agree to attempt to resolve the dispute informally by providing written notice and allowing at least 30 days for good-faith discussion.

If the dispute cannot be resolved informally, it may be submitted to a court or other dispute-resolution forum with jurisdiction under applicable law.

Nothing prevents either party from seeking urgent injunctive or equitable relief relating to intellectual property misuse, unauthorized access, security abuse, privacy violations, or unlawful use of the Services.

Any waiver of class, representative, or consolidated proceedings applies only to the extent permitted by applicable law.

Miscellaneous

These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and Truthy regarding the Services.

If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not waive our right to enforce it later.

You may not assign or transfer these Terms without our written consent.

We may assign these Terms in connection with a merger, acquisition, restructuring, asset transfer, or operation of law.

No partnership, employment, agency, fiduciary, or joint venture relationship is created between you and Truthy.

We are not responsible for failures or delays caused by events beyond our reasonable control, including natural disasters, war, government actions, internet failures, platform outages, provider interruptions, legal restrictions, or other force majeure events.
